How Fast Do Electric Bicycles Go? The Order to Work It Out

Most electric bicycles sold in the United States stop assisting at either 20 mph or 28 mph, and the gap between those two numbers is a legal setting rather than a measure of what the machine can do. Federal product law, at 15 U.S.C. § 2085 and 16 CFR 1512.2, defines a low-speed electric bicycle as one with fully operable pedals, a motor under 750 watts, and a top speed below 20 mph when driven by the motor alone, on a paved level surface, carrying a 170-pound rider. The 28 mph figure comes from a different authority: state statutes that adopted the bicycle industry's three-class system, in which a Class 3 e-bike cuts assistance at 28 mph while the rider pedals. Neither number states how fast a bike may lawfully be ridden on a particular street or path. That is a third authority, and on shared paths it is usually the lowest number of the three.

Three readings, in that order. A speed figure on a listing behaves like a dispatch code on a parcel. It identifies the system that issued it, and not the place the parcel is cleared to go.

What the 20 mph federal number actually measures

The definition dates to Public Law 107-319, signed December 4, 2002, which added section 38 to the Consumer Product Safety Act. Its wording, carried into 16 CFR 1512.2, describes "a two- or three-wheeled vehicle with fully operable pedals and an electric motor of less than 750 watts (1 h.p.), whose maximum speed on a paved level surface, when powered solely by such a motor while ridden by an operator who weighs 170 pounds, is less than 20 mph."

Four test conditions sit inside that sentence. Paved. Level. Motor only. A 170-pound rider. Alter any one and the recorded speed moves.

The phrase most buyers skip is "powered solely by such a motor." Because the test isolates the motor, a pedaling rider adds speed on top of it without leaving the definition. A bike built to the federal standard routinely travels faster than 20 mph.

The Consumer Product Safety Commission's authority covers what may be sold. Under 16 CFR part 1512, a low-speed electric bicycle failing the standard is a banned hazardous substance under the Federal Hazardous Substances Act, a market rule aimed at manufacturers. It says nothing about who may ride where.

The three-class chart describes motors, not jurisdictions

The chart returned by most searches assigns Class 1 to pedal assist cutting off at 20 mph, Class 2 to throttle assist cutting off at 20 mph, and Class 3 to pedal assist cutting off at 28 mph with a speedometer required. The bicycle industry wrote that vocabulary, and PeopleForBikes promoted it as model legislation because federal law covered the product and left riding rules unwritten.

Treating that chart as one nationwide operating law is the error that costs buyers money. It is a labeling scheme individual legislatures adopted one at a time, in wording of their own. Counts of adopting states disagree: PeopleForBikes and much of the trade press say more than 40, while other surveys put it at 36 plus the District of Columbia, the remainder handling e-bikes under existing moped or motor-vehicle definitions. Both figures move as legislatures amend.

John MacArthur and Nick Kobel of the Transportation Research and Education Center at Portland State University surveyed all 50 states, the District of Columbia and 13 Canadian provinces for their report "Regulations of E-Bikes in North America." They found no two jurisdictions exactly alike in their legal treatment of the mode, and recorded that they could not obtain an official CPSC interpretation of the motor-only test. The boundary has been read differently since.

Your state is the second reading, and it moves

State law is where the 28 mph figure becomes real, and where it can be taken away.

Washington's Engrossed Substitute Senate Bill 6110, enacted as Chapter 159, Laws of 2026 and effective June 11, 2026, keeps the three classes and their 20, 20 and 28 mph cutoffs while narrowing the entry gate. The amended RCW 46.04.169 excludes any vehicle "capable of exceeding 20 miles per hour on solely its electric motor," and machines "designed, manufactured, or intended by the manufacturer or seller to be easily configured" out of compliance. The legislature cited the "recent proliferation of electric motorcycle use statewide, especially among teenagers and young adults."

New Jersey went the other way. Under S4834, Class 1 machines keep low-speed electric bicycle status while Class 2 and Class 3 become motorized bicycles carrying licensing, registration and insurance duties. Dr. Ash Lovell, vice president of government relations at PeopleForBikes, wrote that the law "eliminates the widely adopted three-class system used in most states and replaces it with a framework that treats nearly all electric bicycles more like motor vehicles."

California shows how much a state adds beyond the speed number. Vehicle Code section 312.5 requires a speedometer on Class 3. Section 21213 bars anyone under 16 from operating one and requires a helmet for every Class 3 rider and passenger at any age, stricter than the rule for ordinary bicycles. Section 24016 exempts qualifying e-bikes from licensing, registration, plates and insurance, and that exemption ends the moment a bike falls outside section 312.5.

Two riders can buy the identical 28 mph bike and inherit different duties. The bike did not change.

The path or park is the third reading, and usually the lowest

Path authorities regulate travel speed; class definitions regulate motor cutoff. They are separate instruments, and the path number is generally smaller.

Marin County, California, allows Class 1 and Class 2 e-bikes on county paved multi-use pathways while barring Class 3 from parks facilities outside roadways and parking lots. Its published guidance caps all bicycles and e-bikes at 15 mph on county-maintained pathways, dropping to 10 mph on the Bayfront Park section of the Mill Valley–Sausalito path. A 28 mph Class 3 machine therefore faces a lawful ceiling of 10 mph there, enforced with LIDAR under the county's Share the Path program.

Albuquerque permits all three classes on city trails at a maximum of 20 mph unless posted lower, and 15 mph on unpaved Open Space trails.

Federal land inverts the assumption. National Park Service policy lets superintendents treat classes differently through each park's compendium, and Grand Canyon National Park permits Class 1 and Class 3 e-bikes wherever traditional bicycles are allowed while prohibiting motor propulsion without pedaling, which is Class 2 behavior, except on roads open to motor vehicles. At New River Gorge, the Stone Cliff Trail admits Classes 1 and 2 only. The fastest class is not automatically the restricted one.

Motor wattage does not predict top speed

A motor rating is a rating, not an outcome. Ride1Up's published specification for the Vorsa lists a 750-watt AKM hub motor with 95 Nm of torque, a 48-volt 25-amp sine-wave controller, and a 48-volt 15 Ah battery of roughly 720 watt-hours. Ride1Up's support documentation states the relationship plainly: watts equal volts times amps. Run that on the Vorsa and the controller can pass about 1,200 watts to a motor labeled 750, more still at full charge, since a 48-volt nominal pack leaves the charger near 54 volts. The company's LMT'D V2 pairs a similar 750-watt motor with a 48-volt 20-amp controller and a 672 Wh pack. Same headline wattage, different delivery.

Mass eats a large share of it. The Vorsa Standard XR is listed at 65 pounds without accessories, so a 180-pound commuter moves roughly 245 pounds before cargo.

Grade decides the rest. Electric Bike Report runs every bike it reviews up a course it calls the Devil's Backbone, a paved climb averaging 8 percent grade over half a mile for 217 feet of elevation gain, ridden by the same tester, Justin Taylor, at six feet and about 180 pounds. Its published method records that some e-bikes cannot reach the top on throttle power alone, a plainer verdict on a 28 mph label than any flat-ground figure.

The last variable is software. The Vorsa ships configured as Class 2, limited to 20 mph on throttle and pedal assist alike, and the owner can reconfigure it to Class 3 or an off-road mode. The governing number is the one currently loaded in the controller, which is why the manual and display settings, not the marketing page, are the document to read.

Downhill speed belongs to gravity, not the motor

Any bicycle exceeds its assist cutoff on a descent. A Class 1 machine coasting at 32 mph is not a 32 mph e-bike; its motor stopped contributing at 20. A downhill GPS reading measures the hill.

Class definitions describe where the motor stops assisting. Neither Washington's amended statute nor California's section 312.5 turns a coasting rider into a moped operator.

A legal Class 3 e-bike compared with an electric moped

Legal status separates the two categories; capability does not. Asha Weinstein Agrawal, professor of urban and regional planning at San José State University's Mineta Transportation Institute, told KQED that "there are all kinds of devices out there, and some of them fit California's very specific legal definition of what an e-bike is, but many of them don't." A Marin County survey she cited found 88 percent of electric devices at schools exceeded legal e-bike specifications, and she put e-motorcycle and e-moped speeds near 38 mph against the classes' 20 and 28.

Misclassification also corrupts the crash record, in Agrawal's reading, because "all kinds of devices that are probably not legal e-bikes are getting classified as e-bike crashes."

Reading a listing before you pay

  1. Confirm the federal label: fully operable pedals, motor under 750 watts, compliance with 16 CFR part 1512. A machine missing that is being sold as something else.
  2. Read the manual for the programmed cutoff and the shipped class. Note whether the owner can reconfigure it, and whether an update can move it.
  3. Look up the current statute in the state where the bike will be ridden, with its effective date. Washington and New Jersey both changed in 2026.
  4. Check the path, park or trail authority separately, and expect a lower number than the class allows.
  5. Compare the machine against the state's moped threshold. Crossing it converts a bicycle into a registered vehicle.
  6. Treat any advertised maximum without stated test conditions as unverified. A grade, a rider weight and a surface belong with the number.

Can e-bikes go 60 mph?

No machine meeting the federal low-speed electric bicycle definition at 16 CFR 1512.2 approaches 60 mph, since that standard caps motor-only speed under 20 mph with a motor below 750 watts. Devices marketed at 60 mph are electric motorcycles in law, requiring registration, licensing and insurance in most states.

Can e-bikes go 50 mph?

Not as legal e-bikes. Washington's amended RCW 46.04.169 excludes any vehicle capable of exceeding 20 mph on the motor alone, and California caps assist at 28 mph for Class 3. A 50 mph machine falls outside both, landing in motorcycle categories with plates, insurance and endorsement requirements attached.
